Creator Terms.
What you agree to when you release music on Vynl.
Draft for legal review. This text is an example. It does not bind anyone yet and will be replaced once a lawyer has reviewed it. Fields in [brackets] are still to be filled in.
1. Who these terms are for
These terms apply to anyone who turns on creator mode in the Creator Studio. They come on top of the Terms of Use and the Privacy Policy. You must be [18] or of full legal age, or act for an organization you can legally bind.
2. Your content and your rights
- Only upload content you own or have licensed, with the right to publish it on Vynl.
- Do not upload content that infringes someone else's rights.
- Do not imitate the voice or likeness of a real person without their permission.
- You stay the owner of your content. You are responsible for agreeing any split with the people who worked on it.
3. Declaring how AI was used
You must declare each track as AI-assisted or AI-generated, accurately, and you can add a few words to explain. Declarations are kept as a history and never overwritten: a new one is added next to the old one. A false declaration can lead to the removal of the track or the suspension of your account.
4. Review and publication
Tracks are reviewed before they go live in the catalog. We can refuse a track, or remove it later, if it breaks these terms or the law. Keep the information on your tracks and releases (title, artist, genre) accurate.
5. What you allow Vynl to do
You give Vynl a non-exclusive, worldwide right to host, stream and display your content and your artist page, for the sole purpose of running the service. This right ends when your content is removed, apart from the records we must keep by law.
6. Royalties and payouts
Royalties and payouts are not live during the beta. Plays are recorded but not paid. Before payouts start, the royalty rules will be published and these terms updated. Payouts will go through a payment provider, which may require you to verify your identity.
7. Fair play
Do not create artificial plays, by yourself or through others. We can exclude suspicious plays from any count and close the accounts involved.
8. Rights claims
If you think content on Vynl infringes your rights, write to [rights contact email]. We can remove content after a credible claim. [Procedure for a reply from the creator, to be drafted by counsel]
9. Leaving Vynl
You can delete your account at any time. Your artist page is then anonymized, your releases are archived, and your audio files and images are deleted after [30 days], unless a legal hold applies. Records we must keep by law, such as accounting records, are kept for [10 years]. A balance that is owed to you is paid before closing, once payouts exist.
10. Responsibility
You are responsible for your content. [Indemnity and limitation of liability, to be drafted by counsel]
11. Versions
We record which version of these terms you accept, and when. When they change in a way that matters, we will ask you to accept the new version.
12. Governing law
[Governing law and place of jurisdiction, to be confirmed by counsel]. Questions about these terms: [contact email].
